What is an Easement? Do you need easement advice or preparation?

An Easement provides the right for one property to use a part of another property for a specific purpose only. The most common easements are:

Easement Types

Easements must be created by a Registered Surveyor and can be created in one of the following ways:

Development and Annexures

Plans of Subdivision utilise 88B Instruments to be executed by your solicitor. Plans of Easement and Annexures are more direct and do not require an 88B Instrument. Some developments that are not Subdivisions still require Easements to be created. Annexures are appropriate options in these cases.
